Plots come with more legal strings than back gardens. The things a clearance specialist checks first — worth knowing whoever does the work.
Bird nesting season. Under the Wildlife and Countryside Act 1981, it's an offence to intentionally damage or destroy an active bird's nest — and dense scrub is prime nesting habitat. Between roughly March and August we check thickets and hedges before cutting and work around any active nests we find. Big scrub clearances are best planned for autumn and winter; it's also simply the easier season to do them.
Protected trees and conservation areas. Trees under a Tree Preservation Order — and most trees in a conservation area — legally need council consent before works, and the fines for getting this wrong are serious. If a plot has established trees, check with the local council's tree officer before anyone cuts. We'll tell you plainly which growth on your plot is fair game and which needs that check first.
Countryside hedgerows. Under the Hedgerows Regulations 1997, removing certain hedgerows on land adjoining open countryside needs prior notice to the council, which can refuse. Cutting a hedge back is fine — removing one on a rural boundary may not be. If your plot borders fields or lanes, it's worth a check before removal, and we'll flag anything that looks in scope when we quote.
Invasive plants on development land. Japanese knotweed on a plot is a genuine liability — it's controlled waste that can't go in an ordinary load, careless cutting spreads it, and it can complicate sales and mortgages. We won't chop it into the van; if we spot it, we'll tell you honestly and point you at the specialist route. Running bamboo gets similar respect: cutting the canes doesn't kill it.
And whoever clears it: under the Environmental Protection Act 1990 there's a duty of care for waste leaving the land, and fly-tipped green waste traces back to its source. Always ask for the trader's waste carrier registration number and check it on the public register — we'll happily show you ours before we load a single branch.
